Worker Killed By DUI Hit-and-Run
August 08, 2014
A 57-year-old subcontractor who was cutting asphalt with a wet saw in a bus lane on West Sahara Avenue was killed after being struck by a drunk driver, according to reports. Around 9:44 a.m., the worker was standing behind his parked and unoccupied 2001 Chevrolet W4500 when he was hit by a 2004 Ford F-150. Police initially thought two vehicles were involved in the accident, but soon came to realize that the worker’s saw had been thrown from the scene into another vehicle. The worker died at the scene of the accident. The driver of the Ford F-150 continued to drive, finally hitting another car and then parking his car. After exiting the vehicle, the driver fled the scene on foot, but was later found by police hiding in a nearby apartment building dumpster. The driver was identified as Rafael Mendez-Soto, 41, who suffered only minor injuries. Mendez-Soto failed the field sobriety test, resulting in an arrest with charges of DUI involving a death as well as leaving the scene of an accident involving a death.
DUI INVOLVING INJURY OR DEATH
Those who commit the crime of driving under the influence of alcohol and cause an accident resulting in an injury or death can face felony DUI charges in the state of Nevada. According to Nevada law, a DUI causing bodily injury or death is punishable by two to 20 years in prison and fines ranging from $2,000 to $5,000. Aside from criminal prosecution, those who commit DUI can also face civil action with a personal injury lawsuit filed by the victims of their negligence.
